By accessing or using Beyond The Gears ("the Platform"), operated by GoldSpot Athletic Club, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

Eligibility

You must be at least 13 years of age to use this Platform. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate and complete.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with third parties
  • Not create multiple accounts for deceptive purposes

Acceptable Use

You agree not to use the Platform to:

  • Post false, misleading, or fraudulent content
  • Harass, abuse, or threaten other users
  • Upload malicious software or interfere with Platform operations
  • Scrape, crawl, or collect data without authorization
  • Impersonate another person or entity
  • List counterfeit or stolen goods on the marketplace

Marketplace & Transactions

Beyond The Gears provides a marketplace for buying and selling cycling-related products and gear. By using the marketplace, you agree that:

  • Sellers are responsible for the accuracy of their listings and the quality of items sold
  • Buyers are responsible for reviewing listings carefully before purchase
  • All payments are processed securely through Stripe; we do not store payment card details
  • Refund and return policies are as stated at the time of purchase
  • We reserve the right to remove listings that violate these terms

Events & Registrations

Event organizers are responsible for the accuracy of event details, safety measures, and compliance with local regulations. By registering for an event:

  • You acknowledge that cycling involves inherent risks
  • You participate at your own risk and responsibility
  • Cancellation and refund policies are set by individual event organizers
  • We are not liable for injuries, damages, or losses incurred during events

AI Coaching Services

Our AI-powered coaching features provide general fitness and training suggestions. These are not a substitute for professional medical or coaching advice. You should consult a qualified professional before starting any new training program. We are not liable for any injury or health issue arising from following AI-generated recommendations.

Intellectual Property

All content, design, logos, and software on the Platform are the property of GoldSpot Athletic Club or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Content you post on the Platform (listings, reviews, messages) remains yours, but you grant us a non-exclusive, royalty-free license to display and distribute it within the Platform.

Third-Party Integrations

The Platform integrates with third-party services including Strava, Google, and Stripe. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability or conduct of third-party services.

Limitation of Liability

To the maximum extent permitted by law, Beyond The Gears and GoldSpot Athletic Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, revenue, or profits.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms. You may also delete your account at any time through your profile settings or by contacting us.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify users of significant changes by posting a notice on the Platform. Continued use after changes constitutes acceptance of the revised terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.
